Sovranità limitata?

Ieri il ministro della Giustizia, Roberto Castelli, ha definito “un militante” il sostituto procuratore Armando Spataro che sta chiedendo l’estradizione dagli Usa di presunti agenti della Cia sospettati di coinvolgimento nel rapimento in Italia dell’ex imam Abu Omar [Reuters].

Castelli ha, tra l’altro, dichiarato:

  • “siccome in questo caso siamo di fronte ad un magistrato militante la faccenda è da valutare con grande attenzione”.
  • “Stiamo esaminando le carte per capire bene se il teorema è fondato o se è legato ad una sorta di antiamericanismo che attraversa purtroppo la sinistra”
  • “Siccome la legge dà al ministro la facoltà di decidere se dare esito o meno alle richiesta della magistratura, caso rarissimo perché la magistratura è indipendente, è evidente che la ratio è che è il ministro a decidere sulla fondatezza di queste accuse”

 

E’ opportuno ricordare anche altri fatti:

In questo periodo sono state avviate alcune inchieste internazionali sul tema delle operazioni segrete della CIA in Europa:

Three European countries are considering judicial inquiries into potential criminal offences related to CIA operations in Europe.

The cases have been underway for some time, but gained increasing attention after recent press reports that the US intelligence agency, the CIA, has held suspects in covert detention centres in eastern Europe.



Italy and Germany are also considering judicial inquiries into potential criminal offences related to CIA operations in Europe.

The Bush administration could see a formal request from Italy to extradite 22 past and present CIA operatives accused by a Milan prosecutor and judge of kidnapping a radical imam nearly three years ago.

Italian justice minister Roberto Castelli said after a visit to Washington on Thursday (ndr: 10/11/2005) that he would see the legal papers and then decide whether to forward the extradition request to the US.

In Germany, a separate investigation has been opened into the February 2003 kidnapping of an imam known as Abu Omar.

The man was picked up in Milan, taken to an Italian air base then put aboard a military flight to Germany and finally ended up in Cairo.

The Aviano air base in Italy and the Ramstein air base in Germany are both home to US air force units.

The German prosecutor, Eberhard Bayer, whose district includes the Ramstein base, is now studying the evidence before deciding whether a crime was committed.

Today (14 November) members of the European Parliament will debate the reports of secret CIA detention camps in Europe, following a statement from the European Commission.

Last week the Council of Europe in Strasbourg appointed Swiss liberal politician Dick Marty to examine the existence of alleged secret American detention centres for terror suspects.

The United Nations’ special rapporteur on torture, Manfred Nowak, might also launch an investigation.

The Austrian said last week that if reports of the CIA’s activities proved correct, then the agency was engaged in a “systematic practice of enforced disappearance,” (why don’t they just say ‘kidnapping’ ?) according to the New York Times.

The Council of Europe has demanded an investigation into claims the US ran secret jails for terror suspects.
The human rights watchdog called the claims “extremely worrying” and said such prisons would constitute a serious human rights violation.

Domani, 25 Novembre, Dick Marty, nominato il 7 Novembre scorso presidente della Commissione per gli affari giuridici e i diritti dell’uomo dell’Assemblea parlamentare del Consiglio d’Europa (APCE), presenterà i primi risultati dell’inchiesta [agenziaaise].

Dick Marty ha dichiarato: “far scomparire delle persone sottraendole ad ogni controllo giudiziario e amministrativo è un atto contro la dignità umana. Il continente europeo ha talmente sofferto del mancato rispetto della dignità umana che il Consiglio d’Europa ha sviluppato un approccio completamente nuovo e mezzi in grado di garantire l’applicazione dei diritti dell’uomo in ogni circostanza. Non siamo interessati a nessun tipo di anti-americanismo, né miriamo ad indebolire la lotta al terrorismo, ma è nostra convinzione che combattere il terrorismo, violando i diritti dell’uomo sia del tutto controproducente. Creando un sentimento di ingiustizia, tali violazioni non rappresentano altro che una vittoria per i terroristi, il cui obiettivo è precisamente la distruzione dei principi dello Stato di diritto, che governano le nostre società. L’unica maniera efficace di combattere il terrorismo è utilizzare strumenti morali ‘onesti’”.

 

Altro fatto, sempre di questi giorni, è la richiesta, fatta al Congresso dal vicepresidente statunitente Dick Cheney, per garantire una esenzione per la Cia ad un emendamento legislativo che mira a proibire il trattamento «crudele e inumano» dei prigionieri nelle mani degli americani. [l’Unità]

 

E’ evidente che la ratio ci fa affermare, diversamente rispetto a Castelli, che non ha senso ridurre tutta la questione ad un antiamericanismo tipico di una Magistratura italiana troppo politicizzata.
Piuttosto non si può sospettare che la visita del ministro, effettuata il 10 Novembre a Washington, non sia servita a ricevere nuovi ordini?
